ZBA Minutes NOV 15 2012
The Zoning Board of Appeals of the Town of Avon held a meeting on Thursday, November 15, 2012 at the Avon Town Hall.  Present were Messrs. Ladouceur, Johansen, McNeill, Ms. Hard, Ms. Aube, & Mr. McCahill, Planning & Community Development Specialist.  Mr. Ladouceur called the meeting to order at 7:30 p.m.

The Clerk read the call to meeting.

Mr. Ladouceur read the Application of Ramesh Janakiraman & Rama Ramanathan, owners/applicants; requesting from the Avon Zoning Regulations, Section IV.A.6., a 20’ variance from the 25’ side yard setback requirement to permit a 10’x14’ shed located at 191 Woodmont in an R-40 zone.  He then read the letters of approval from neighbors Mr. Dan Pasmanik, 5 Fall Brook, Craig Adams, 98 Woodmont, Kazimiera Zamoyska Rowalski, 201 Woodmont, Cathy Arciero, 10 Fall Brook, Dwayne Connelly, 93 Woodmont.  Mary Lynn Nolan, 25 Manitook Mt. had been at the town hall inquiring about the shed and said she had no problem with the application.

Mr. Janakiraman was present.  He stated his wife was not here as she was traveling.  He is looking for a variance to put in a small shed in the side yard.  The hardship is the land is covered by wetlands and a conservation area where no construction is allowed.  In a picture there is a tree branch knocked over and that is where the shed is proposed.  They went to all their neighbors and explained the situation and they had no problem with the application.

Mr. Ladouceur commented looking at the map that the lot is a unique shape, it’s almost a trapezoid lot where the house is squeezed in as there is a lot of wetlands.

Mr. McCahill said this is one of those properties that is punished in every direction.  It’s a lot of record that it’s been existing for a long time.  The house was only built about 7 or 8 years ago but it’s subject to a 60’ setback from Woodmont which is a collector road and a 40’ setback from Fall Brook direction as it’s a corner lot.  They came in originally for a building permit request in the conservation easement area, but there is no flexibility there.  This lot has a lot of constraints in every direction.

There was no one else present.  The Public Hearing closed at 7:40 p.m.

A Zoning Board of Appeals meeting was held following the Public Hearing.


Ms. Aube made a motion to GRANT, seconded by Ms. Hard the Application of Ramesh Janakiraman & Rama Ramanathan, owners/applicants; requesting from the Avon Zoning Regulations, Section IV.A.6., a 20’ variance from the 25’ side yard setback requirement to permit a 10’x14’ shed located at 191 Woodmont in an R-40 zone.  The vote was unanimous by Messrs Ladouceur, Johansen, McNeill, Ms. Hard & Ms. Aube.

Reason – To grant variance is in harmony and keeping with the purpose and intent of the regulations and would not be injurious to the neighborhood.

Hardship – To deny would deprive the owner of a reasonable use of the property.

There being no further business the meeting was adjourned at 7:43 p.m.
